Este artigo discute a terceirização nas relações de trabalho em pequenos negócios, sobretudo nas questões relacionadas à segurança no trabalho, aos descumprimentos contratuais que se traduzem em ações trabalhistas e às reais dificuldades para a efetiva entrega da prestação jurisdicional quando a terceira é reconhecida como obrigada pelo pagamento do quantum reconhecido como sendo direito do trabalhador lesado; ou seja, os impactos da terceirização na execução da sentença que transitou em julgado, aliás, “calcanhar de Aquiles” da Justiça do Trabalho. Além disso, lança algumas sugestões de políticas públicas e de medidas que possam superar essas dificuldades.

Title: Outsourcing and its impact on labor relations in small business and the slowness in implementing the labor justice execution

In this article outsourcing of labor relations in small business is discussed, focused mainly in questions associated to labor safety, breaching of contracts that lead to labor lawsuits and to real difficulties for the effective compliance of the decision when a third part is identified to the due payment of the value decided as the worker’s legitimate right; in other words, the impacts of outsourcing in the execution of the sentence transited in rem judicatam, which is, by the way, the Achilles Heel of Labor Justice in Brazil. Besides, it suggests some public policies and measures that could overcome those difficulties.
