Este trabalho visa demonstrar a transformação histórica no decorrer dos tempos em relação ao direito à nacionalidade. Para isso, percorre as referências ao direito à nacionalidade, desde as civilizações mais antigas até as atuais. Além disso, busca resgatar as referências no ordenamento jurídico internacional, que inspira a conformação da nacionalidade no Brasil. O intuito é discutir o recorte de gênero, a partir da Nova Lei da Migração e a ausência desse debate em diferentes esferas./SPAN>

Title: Migrant women: invisibility, the right to nationality and intersectionality in public policies

This paper aims to demonstrate the historical transformation in the course of time related to the right to nationality. Therefore, it goes through references to the right to nationality, from the earliest civilizations to the present. In addition, it seeks to retrieve the references in the international legal order, which inspires the formation of nationality in Brazil. The intention is to discuss the gender cut, from the perspective of the New Migration Law and the absence of this cut in diferente spheres.
