Updates of the new Brazilian migratory law: a new paradigm of migration?

Após quase quatro décadas de vigência do Estatuto do Estrangeiro, uma nova lei migratória foi sancionada no Brasil, apresentando um avanço no trato da questão da imigração, que tem sido negligenciada pelo Estado. Entretanto, mesmo diante dessa importante atualização, há de se considerar que a integração dos imigrantes ao país sempre foi – e ainda é – um processo desequilibrado, visto a histórica hierarquização de raça, gênero, cultura e classe social vivenciada no Brasil. Este artigo aborda, portanto, a nova lei de migração em sua interface com a conjuntura de marginalização desses imigrantes, a fim de identificar os avanços trazidos pela nova legislação, mas abordando insuficiências remanescentes./SPAN>

Title: Updates of the new Brazilian migratory law: a new paradigm of migration?

After almost four decades of validity of Estatuto do Estrangeiro, a new migration law was sanctioned in Brazil, representing an advance to the immigration issue, which has been neglected by the State. However, even with this important update, it is necessary to consider that the integration of immigrants to the country has always been – and it still is – an unbalanced process, given the historical hierarchy of race, gender, culture and social class experienced by Brazil. This article discusses therefore the new migration law in its interface with the marginalized situation of these immigrants, in order to identify the advances brought by the new legislation, but addressing remaining shortcomings.
