The exceptionality of international adoption in respect of the international traffic of minors

O presente artigo visa analisar o instituto da adoção na modalidade internacional, sob a luz da sua função social e humanitária, relacionando-a com os procedimentos legais adotados para o combate ao tráfico internacional de menores. Parte-se da premissa que o instituto da adoção é dos mais antigos da história da humanidade e, que a adoção, seja na modalidade nacional, seja na modalidade internacional, possui uma finalidade altruísta e é benéfica para os envolvidos. No cerne de seu surgimento, a adoção internacional emergiu como símbolo da fraternidade mundial no período após a segunda grande guerra, no qual milhares de crianças ficaram órfãs e impossibilitadas de permanecerem em suas famílias biológicas, ensejando a saída dos seus países de origem. Por outro lado, a outra forma de circulação de crianças e adolescentes pelo mundo é o tráfico internacional, modalidade esta criminosa que deve ser combatida. Ocorre que, é possível identificar que o Estado brasileiro efetivamente dispõe e regulamenta acerca da adoção internacional, considerando-a uma modalidade excepcional e destinando a esta cuidados legislativos especiais, sendo possível se concluir que há o intuito de prevenir o tráfico internacional de menores ao dificultar essa modalidade de adoção. Contudo, o burocrático procedimento que envolve o instituto, pode configurar um obstáculo para a formação de novas famílias.

Title: The exceptionality of international adoption in respect of the international traffic of minors

With this paper we intend to discuss international adoption, in view of its social and humanitarian features and considering the legal proceedings concerning the fight against international child trafficking. First, we must take into account that adoption is one of the oldest practices in history and that, either domestic or international, it carries along a sense of altruism and benefits all of the parties involved. International adoption has emerged as a symbol of world brotherhood, as millions of children became orphans after the Second World War and were led to leave their birth fam ilies and their home countries. On the other hand, child trafficking is a criminal action which also represents a significant way of circulation of children and teenagers around the globe, and must be contained. Brazilian legislation has effectively stated laws and regulations concerning international adoption, which is a practice that is considered exceptional by the country’s legal system and has specific rules to be dealt with. Taking that into consideration, it can be inferred that the Brazilian State takes action in order to prevent international child trafficking by legally containing this type of adoption. However, the bureaucracy involving the adoption process in the country may represent instead a setback for the construction of new families.
