O presente trabalho inscreve-se no âmbito de investigações sobre aatuação do Direito como agente de perpetuação ou enfrentamento das desigualdades raciais. Pretende-se contribuir para análise doRacismo Institucional no Poder Judiciário, mais especificamente no Tribunal de Justiça do Estado do Rio de Janeiro, a partir do levantamento de sua atuação no julgamento de ações relacionadas às políticas afirmativas de corte étnico-racial. Foram analisadas as ações judiciais julgadas em segunda instância pelo TJRJ entre os anos de 2002 e 2013. Buscou-se perceber como a “cegueira à cor” e o racismo institucional influenciam a tomada de decisões judiciais sobre essas demandas.

Title: Ethnic-racial affirmative action by Court of the State of Rio de Janeiro (2002-2013)

This work falls within the framework of research on the role of law as an agent of perpetuation or fighting of racial inequality. It is intended to contribute to analysis of Institutional Racism in the judiciary, specifically in the Court of Justice of the State of Rio de Janeiro, from the time of their performance at the trial related to ethnic-racial affirmative action policies. Lawsuits judged on appeal by TJRJ between the years 2002 and 2013 were analyzed. Goal was to see how the “color blindness”’ and institutional racism influence judicial decision-making on these demands.
